You Spouse Filed For Abuse

Be ready for that. Most likely that’s gonna happen.

I-751 Waiver is a really ugly process for those who faced it. And the only way to pass it successfully is to get a divorce based on abuse. Even if abuse never happened in reality.

My wife did the same to me, but I won.

Just remember several hints:

1. Without a proof of physical abuse this claim most likely will be lost. Your spouse will file for so-called “Cruel treatment / Inhuman treatment” and psychological abuse. Those things are really hard to prove and family court judges are really annoyed with claims like these.

2. Keep in mind that your family judge already saw THOUSAND cases like yours. He sees what is inside you better than X-ray.

3. File a counter-claim. Accuse your wife in cheating and cruel treatment as well.

4. If your marriage was really short, judge will not spend his time on researching who abuse who, and will simply grant you with a divorce based on irreconcilable differences. This is exactly what happened to me. Such a divorce will be a big WIN for you and a big LOSS for your spouse.

5. If your alien spouse filed for abuse against you – you’re not in danger. You will not be fined, penalized, send to jail or deported for that. But if you will ignore the family court procedure, your spouse can get it without your presence. So if you want to fight back and to punish your spouse who used you for a green card – you need to take participation in this case.
