You just got rid of the person who used you for a green card. It’s time to start a new life and to find a person who will marry you in a good faith!
But you still want to punish a person, who screwed you, right? Mostly likely that how you found this blog.
Your spouse has a conditional 2-year green card and conditions need to be removed. He/she no longer file for I-751, because he/she is not married. So your spouse will file for I-751 Waiver based on divorce or annulment.
If you’ve read all my previous articles and you did everything right, you can have two relatively good results: your marriage ended up in annulment (if you were really goal-oriented and had a lot of money) or in an uncontested divorce based on irreconcilable differences. Both of these options will be a real pain in the ass for your spouse.
If your divorce ended up in abuse, most likely your spouse will get a new green card with no problems.
But let’s talk about first two options.
Annulment based on a immigration fraud is black spot for your spouse forever. It will stay in his/her background records till the rest of the life. He or she can appeal this decision in the Supreme Court. Because filing for I-751 Waiver with that is barely worthless. With 99% possibility I-751 form will be denied and your spouse’s case will be send to immigration court.
Divorce based on differences puts a burden on your spouse. A burden to prove that he/she has entered into this marriage in a good faith.
